Terms & Conditions (Website Terms of Use)
R.I.C Diagnostics Inc., (Reproductive Immunology Canada) (“RIC”, “we”, “us”, “our”)

1) Acceptance of these Terms
By accessing or using this website (the “Site”), you agree to be bound by these Terms & Conditions (the “Terms”). If you do not agree, do not use the Site. We may update these Terms at any time; continued use means you accept the revised Terms.

2) Eligibility & Jurisdiction
The Site is intended for individuals 18 years or older. These Terms are governed by the laws of Ontario and applicable federal laws of Canada. You submit to the non-exclusive jurisdiction of Ontario courts for disputes arising from the Site or these Terms.

3) No Medical Practice, No Medical Advice, No Emergency Service
RIC is not a medical practice and does not provide diagnosis or treatment. Site content (articles, FAQs, downloads, questionnaires/quizzes, messages) is informational/educational only and not medical advice. Use of the Site or our services does not create a physician–patient relationship. Always consult your treating physician or reproductive endocrinologist. Do not use the Site for emergencies; call 911 (or your local emergency number).

4) Professional Roles & Scope (Nurse Practitioners / Registered Nurses)
Registered Nurses (RNs) and Nurse Practitioners (NPs) engaged by RIC carry out blood draws, specimen handling, and related logistics within their professional scope and provincial standards. Where a test requires an authorized ordering provider, it will be ordered by an NP (within scope) or a collaborating authorized provider—or not performed. RIC may coordinate with your clinic/physician at your direction.

5) Telehealth, Lab Services & Limitations (if offered)
If RIC offers telehealth consults or coordinates laboratory testing:

Separate consents/agreements will apply at booking or intake.

Test limitations: Reproductive immunology tests have analytical/clinical limits and do not guarantee pregnancy outcomes; results must be interpreted with full clinical context.

Third parties: We may rely on independent labs, couriers, payment processors, and telehealth platforms. RIC isn’t responsible for outages/delays/errors outside our reasonable control.

6) Home Visit Terms (Mobile Phlebotomy)
You agree to provide a safe, well-lit area for venipuncture; restrain pets; disclose hazards (e.g., smoke, aggressive animals); and ensure an adult (18+) is present. Staff may decline or end a visit if conditions are unsafe; a call-out fee may apply. You consent to ID verification before collection.

7) Informed Consent – Venipuncture & Risks
Venipuncture involves inserting a sterile needle to collect blood. Typical side effects include temporary pain/bruising/dizziness; rare risks include hematoma, infection, or nerve irritation. By proceeding, you consent to the procedure and agree to follow pre/post-draw instructions. (Separate Mobile Phlebotomy Consent will be required)

8) Specimen Handling, Transport, Turnaround & Re-draws
Specimens are labelled, packaged, transported per lab requirements (including temperature control). Turnaround times are estimates and may be affected by courier delays or lab capacity. If a specimen is rejected/compromised due to factors outside our reasonable control (e.g., courier delay, extreme temperatures), we will arrange a re-draw; additional call-out fees may apply.

9) Test Ordering, Result Delivery & Sharing
Testing is performed only when legally authorized. Results may be shared via secure portal/email or reviewed in a consult. With your explicit consent, we can share results with your physician/clinic. Any written summary we provide is informational and not a treatment plan.

10) Eligibility & Contraindications
You must disclose anticoagulant use, bleeding disorders, recurrent syncope, latex/adhesive allergies, or infection at the intended draw site. We may defer service and refer you to a clinic setting if indicated.

11) Infection Control & Medical Waste
We use single-use sterile equipment, hand hygiene, and surface disinfection per standards. Sharps and biohazard waste are disposed of via approved streams.

12) Accounts, Privacy, PHI & Consent

Accuracy: You warrant that information you provide is accurate and complete.

Privacy: Personal information (including PHI) is handled under our Privacy Policy (link: [URL]) consistent with PIPEDA and applicable provincial law (e.g., PHIPA in Ontario). Do not send PHI via ordinary email/forms unless identified as secure.

Data residency & retention: See Privacy Policy for storage location (e.g., Canada or designated cloud regions), retention, access, and breach notification.

Communications (CASL): By opting in, you consent to receive communications per CASL; you may opt out anytime.

Security: You are responsible for safeguarding account credentials and activities under your account.

13) Intellectual Property & Permitted Use
All Site content (text, graphics, design, logos, images, video, downloads, arrangement) is owned by RIC or used under licence and protected by copyright/trademark laws. You may view/print/download content for personal, non-commercial use without modification and with notices intact. You may not reproduce, adapt, resell, scrape, frame, or mirror Site content without written consent.

14) Acceptable Use & Prohibited Conduct
You agree not to: use the Site for unlawful/fraudulent purposes; introduce malware; attempt unauthorized access; interfere with security/operations; harvest data; or upload content that infringes rights or is defamatory, harassing, hateful, obscene, or otherwise unlawful.

15) User Submissions & Testimonials
Do not post confidential PHI in non-secure areas. By submitting content, you grant RIC a non-exclusive, worldwide, royalty-free licence to use/reproduce/display it for Site operation/improvement (subject to our Privacy Policy). Testimonials/case snapshots are individual experiences, not guarantees.

16) Links to Third-Party Sites
For convenience, the Site may link to third-party sites/tools. RIC does not control and isn’t responsible for their content or policies. Use of third-party sites is at your own risk.

17) Fees, Call-Outs, Cancellations & Refunds (if applicable)

Pricing & taxes: Shown in the indicated currency; taxes/fees may apply.

Payments: Processed by third-party providers; you agree to their terms.

Call-out fee: Applies to each home visit; visits may be bundled when feasible.

Cancellations/no-shows: < [24/48] hours may incur a fee (see booking policy).

Refunds: Consultations, lab processing, and shipping may be non-refundable once commenced. See product/service-specific policies.

18) Electronic Communications & Telehealth Consent (if used)
You acknowledge the risks of electronic communications (e.g., interception) and consent to receive documents/results electronically. For telehealth, you consent to virtual care and understand its limitations versus in-person exams.

19) Accessibility & Accommodations (AODA)
We provide services consistent with AODA and will make reasonable accommodations upon request (e.g., mobility, language support, chaperone preference).

20) Complaints & Professional Oversight
To submit a complaint, contact us at legal@unexplainedinfertility.ca. Concerns regarding an RN/NP’s professional conduct may also be directed to the relevant provincial nursing college. We cooperate with regulators as required.

21) No Warranties
The Site is provided “as is” and “as available”, without warranties of any kind (express or implied), including merchantability, fitness for a particular purpose, title, non-infringement, uptime, or error/virus-free operation. We do not warrant content accuracy, completeness, or currency.
​
22) Limitation of Liability
To the maximum extent permitted by law, RIC (and its directors, officers, employees, contractors, and affiliates) will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data/profits/goodwill/business interruption, arising from or related to use of—or inability to use—the Site or services, even if advised of the possibility. Where liability cannot be excluded, it is limited to the greater of (a) CAD $100 or (b) amounts you paid to us for the relevant Site service in the 3 months before the claim.

23) Indemnity
You agree to defend, indemnify, and hold harmless RIC and its personnel from claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your breach of these Terms, your use of the Site/services, or your violation of law or third-party rights.

24) Security, Availability & Changes
We take reasonable measures to keep the Site secure and available, but we do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Site at any time without notice. We may also update these Terms periodically (see “Effective date”).
​
25) Severability; Entire Agreement
If any provision is invalid/unenforceable, the remainder remains in full force. These Terms constitute the entire agreement regarding Site use and supersede prior or contemporaneous communications.
